I (henceforth also referred to as 'me', 'User' or 'The User' interchangeably) am fully aware that in order to get the Mokusei Scholarship Support for the Student from Mokusei Intelligence Private Limited (henceforth referred to as 'The Company' or 'Mokusei' or 'Mokusei Intelligence' in this document interchangeably) I must first predict the Score that I think the Student will achieve in his or her upcoming exam.

I fully understand & comprehend that just because my score prediction turns out accurate does not mean that Mokusei Scholarship Support is guaranteed for the student for whom the Scholarship Support is sought. I fully understand that the Mokusei Scholarship Support is reserved for up to the first 100 Students from among those who achieve scores that accurately match with the scores that have been predicted for them by the users. I fully understand that my score prediction, even if accurate, needs to be in the FIRST up to 100 Students category of students who are eligible to be awarded the Mokusei Scholarship Support for that particular Academic Season & Scholarship Cycle. I am aware that depending on the registration option I choose and depending on the outcomes or results of other applicants, the student for whom I seek Scholarship Support for can still be considered an eligible candidate for the Scholarship Support even if my prediction does not turn out 100% accurate. This eligibility is subject to certain rules, conditions, and terms as mentioned in the app on the FAQ page, or during selection of registration options, for example.

I fully understand and agree that whatever Score Prediction I make will be applicable for that particular Academic Season & Scholarship Cycle only. For each Fresh & New Academic Season & Scholarship Cycle I will have to apply and register afresh to be considered for Scholarship Support to be disbursed in that particular corresponding Academic Season & Scholarship Cycle

While considering the Category of students eligible to receive Scholarship Support, Scholarship Support Preference will be given to students as per the rules & procedures as mentioned by Mokusei in various screens and documents of this application, and as per the Registration Option that I choose to get my Score Prediction registered with Mokusei. It is my duty to read and understand and familiarize myself with all rules, procedures, legal terms & conditions as mentioned and shared in this application by the Company with all Users. The Company will in no way be responsible for opportunities or rights or claims that I or the Student (if I am not the Student) miss out on because of my lack of personal effort & knowledge.

I am fully aware that in the event where the Student for whom I made a Score Prediction is eligible to receive the Mokusei Scholarship Support but the Company is unable to award the scholarship due to lack or shortage or paucity of funds or due to any other valid legitimate reason whatsoever then the Company will give me a FULL 100% REFUND of the corresponding REGISTRATION FEES that I have paid towards registration for that particular Academic Season & Scholarship Cycle whenever I make a claim for the same within 60 days of receiving such a claim. The Company will refund me this amount WITHOUT MAKING ANY DEDUCTIONS TO IT. I will not hold the company liable for anything at all in such cases and circumstances.

I know and I am fully aware of the fact that I can seek the Mokusei Scholarship Support for either myself, my child, my grandchild, or for somebody else. I cannot seek Scholarship Support for someone that I do not know, and I am not acquainted with, personally. I promise not to create any fake profiles and false registrations to boost my share count or for any other reasons whatsoever. I fully understand that I will be disqualified and barred from receiving any kind of Scholarship Support from Mokusei in such a case and event.

In the event where I predict a Score to seek the Mokusei Scholarship Support for either my grandchild or for somebody else and that Student is found to be eligible to receive the Mokusei Scholarship Support, the Scholarship Support Amount will be credited directly to the bank account of either the student or the individual who paid fees for the student. Only in cases and situations where I myself am, or my child is, a student will the Company credit the Scholarship Amount to a bank account of my choice as per my direction & request.

I am fully aware that the Company will inform and reach out to all Scholarship awardees any time in the months of January and July every year depending on the Scholarship Cycle. The Company will sincerely endeavor to disburse all relevant Scholarships within 6 months of receiving all necessary additional information and documents from the eligible students to crosscheck and verify their Scholarship claims. In case of any delays in disbursement of Scholarship Support to the eligible students the Company will sincerely endeavor to provide an inflation adjusted amount or sum.

I hereby confirm that whatever information and data I have submitted while signing up as a User on this app is absolutely true, genuine, and authentic. I am fully aware and I fully agree that it is my personal responsibility to proactively reach out to the Company and share with the Company any information or data in case of any changes or updates in my contact information or any other document and information that might have a bearing upon the decision of the Company to award me with Scholarship Support. The Company is not responsible for any miscommunication, any loss of communication, any incomplete communication, and so on that might happen in case I have not updated my contact details and contact info with the Company.

I promise to submit only authentic and original and true information or documents to the Company as needed to register for the Scholarship Support, and to support my claim to the Scholarship Support. I am fully aware that if I submit incorrect information, and/or fake results, and/or false documents to fraudulently claim the Mokusei Scholarship then the Student will lose & forego all rights and claims to the Scholarship immediately. The Company has full and complete rights to withhold the Registration Fees that I have paid towards registration in such cases or events.

I am fully aware that THE PREDDICT APP IS NOT A GAMING OR GAMBLING PLATFORM. The purpose of this app is to motivate and encourage students to take their education seriously and study for their exams even better. I am fully aware that this app has features or registration options where Users can make a score prediction FREE OF COST & WITHOUT PAYING ANY MONEY. Whatever registration option and route I take to apply to the Mokusei Scholarship Support even if it is PAID REGISTRATION is entirely and purely my own personal choice.

I am fully aware that in the event that the Company ends up awarding the student for whom I seek Scholarship Support with the Scholarship, and if later upon enquiries & verification of my claims and documents by the Company it turns out that I cheated the Company to fraudulently claim the Scholarship for the Student by intentionally submitting or sharing any false information and/or fake documents to the Company, I will owe the Company and will be legally & personally liable to repay or return the ENTIRE AMOUNT OF SCHOLARSHIP back to the Company at an interest rate of 42% along with all expenses and costs as incurred by the Company to pursue any legal action as needed and necessary for making full recoveries. This interest rate will be applicable from the day I receive the Scholarship Support amount from the Company.

I confirm that it is my duty to read and understand all information on this app as shared by the Company. I agree with all the Rules, Processes, Terms & Conditions as mentioned & shared by the Company here. By continuing to use this app for more than 30 days I also confirm that I am an independent user on this app, the Company can freely assume that I have understood all the rules, procedures, processes, FAQs, terms & conditions as mentioned and stated by the Company on this app. I confirm that I am using the Mokusei service of my own wishes and volition, and that neither the Company nor any Third Party has tricked me or induced me into using this app against my express wishes & desire. I am fully aware that the Company reserves all final rights for, and decisions of, approval or denial of my claim to the Mokusei Scholarship Support for the Student for whom I seek the Scholarship Support.

I fully understand that the ownership of whatever data I share with the Company lies with the Company alone. The Company can use this data as it sees & deems fit for Education Research, as Company asset, for Data Comparison, for Data Sharing with Third Parties if need be for research purposes or monetary gain for example, and so on among other uses of such data. Whatever benefits & gains that arise out of such Data will go to the Company alone. The Company does not need my permission or preapproval of any other kind in any form or format whatsoever to utilize or use this data as it sees fit & appropriate.

Every provision of this Agreement is intended to be severable. If any term or provision hereof is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of the remainder of this Agreement.

I am fully aware and I agree that the Company can, and has a right to, terminate or cancel my User account at any point in time as it deems fit & necessary for any reason whatsoever.

Mokusei Intelligence reserves all and complete and exclusive rights to modify, edit, change, update, or reimagine the rules and processes of the Mokusei Scholarship Process. The Company will ensure that all users are updated either by email, or by phone, or via the app whenever there is a change or modification or update in the Terms & Conditions & Policies of the Company.

It is my duty & responsibility to reach out to the Company proactively in case where I am unclear, or haven't understood properly and thoroughly, certain aspects of the Terms, Conditions, Rules, Procedures, or Policies of the Company.

I know that the Scholarship Support is in the form of REIMBURSEMENT OF SCHOOL OR COLLEGE OR EDUCATIONAL INSTITUTION FEES as incurred by the student in the said Academic Term or Semester for which the Score is predicted. I am fully aware that I will need to submit whatever proof and documents that the Company requests from me, or asks me to, as and when needed like fee receipts, bank account statements, and so on.

I hereby indemnify and agree to hold Mokusei Intelligence and PREDDICT harmless from, and against, all claims, demands, cost (including reasonable attorney fees and court costs) and causes of action of any type or nature, in law or equity, which arise from my use, interpretation or implementation of test results. This indemnification shall survive the termination of the conditions of this Agreement.

Every provision of this Agreement is intended to be severable. If any term or provision hereof is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of the remainder of this Agreement.

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior understandings, if any, with respect thereto. No benefit is conferred under this Agreement on any person, firm, or corporation other than the parties to this Agreement. No representation, warranty, or agreement herein may be relied upon by any person not a party to this Agreement. There are no oral promises, conditions, representations, understandings, interpretations, or terms of any kind between the parties, except as may otherwise be expressly provided herein. No modification or waiver of any term of this Agreement shall be effective against Mokusei Intelligence or Preddict unless it is in writing and signed by the Company.

The terms and conditions provided under this Agreement are subject to change from time to time. The changes shall not be retrospective or retroactive and the Company shall endeavour to keep me updated with any such change in Terms and Conditions by way of email associated with your account. By continuing to use Mokusei's Services after such revisions become effective, I agree to be bound by the revised terms.

This Agreement shall be governed by, interpreted under, and construed and enforced in accordance with the laws of the Republic of India. The parties agree that in the event of any dispute arising from the interpretation or enforcement of this Agreement, they shall endeavour to amicably settle the matter by way of Arbitration to be held in accordance with law applicable to Domestic Arbitrations in India under the Arbitration and Conciliation Act, 1996 as amended from time to time. If arbitration fails, the parties shall be free to approach the Courts by way of litigation. By accepting this Agreement the User accepts that the jurisdiction of all legal disputes shall lie with the Courts of Bengaluru, Karnataka, India. By accepting and signing this Agreement the user accepts that the Company can pursue legal action against the user in any Court of law under any jurisdiction whether domestic or international as prescribed by the law of the land during the time of taking such legal action.
